Regulations on Providing Access to the Information and Advertising Resource for Services of Speech Therapists, Defectologists, and Speech Correction Specialists Logopedy

Logopedy, hereinafter referred to as the Company, publishes this public offer, which is a contract of adhesion, addressed to any legally capable person — an individual, individual entrepreneur, or legal entity, hereinafter referred to as the User / Client, for concluding a contract on the terms set forth below, in accordance with the legislation of the Republic of Kazakhstan.

1. Terms and Parties

Service / Site / logopedy.kz — the Company's information and advertising internet resource located at the domain https://logopedy.kz/, including the site, pages, application forms, phone numbers, messengers, WhatsApp, CRM, call tracking, online booking, advertising, SEO materials, and other communication channels intended for informing Users about the services of speech therapists and speech correction specialists and for technically organizing communication between the User and one or more independent Providers.

Company — Logopedy, the owner of the Site, domain, software and technical infrastructure, channels for attracting inquiries, advertising and SEO materials. The Company creates, develops, promotes SEO, provides technical support, and grants access to the Site.

The Company does not provide speech therapy, defectology, pedagogical, psychological, medical, or other remedial services, does not conduct diagnostics or sessions, is not a speech therapy center, educational or medical organization, employer of the Service Provider's specialists, and is not a party to the service agreement between the Client and the Service Provider.

User / Client — a legally capable individual, sole proprietor, or legal entity using the Site to search for speech therapy services and/or to contact a Service Provider. If the inquiry is made on behalf of a minor or another person requiring representation, the User confirms they have the authority of a legal representative or another proper basis for such an inquiry and for transmitting information about that person.

Provider — an independent speech therapist, defectologist, speech correction specialist, speech therapy or child development center, office, sole proprietor, LLP, or other entity that actually provides speech therapy, defectology, diagnostic, and/or related services to the Client (or the person on whose behalf the Client acts) based on their own qualifications, permits (if necessary), documents, agreement with the Client, and/or actual relationship.

Student / Child — the individual who directly receives speech therapy services, including a minor on whose behalf the Client (legal representative) acts.

Request — an inquiry from a User / Client submitted via the Site, phone call, WhatsApp, messenger, feedback form, online booking, call tracking, or other communication channel indicated on the Site. A Request may be made orally, in writing, electronically, or in another form.

An application is not a contract for the provision of services with the Company and does not create obligations for the Company to conduct diagnostics or sessions.

Service — speech therapy, defectology, diagnostic, remedial, consultative, or other service (speech diagnostics, speech sound establishment and automation, correction of sound pronunciation, work with speech delay, stuttering, dysarthria, dyslexia and dysgraphia, sessions with children and adults, and others) actually provided by the Service Provider.

Acceptance — full and unconditional acceptance of the terms of this offer by the User / Client, expressed by any action aimed at using the Site or communication channels: a call, submitting an application, requesting session costs, booking a diagnostic or session, a message in a messenger, providing personal data, or any other inquiry through the Site.

Agreement — an arrangement between the User / Client and the Company, concluded by acceding to this offer.

2. Acceptance of the Offer and Changes

2.1. This document is a public offer. Use of the Site, making a call, submitting an application, booking a session, or any other inquiry through the Site's channels constitutes acceptance of this offer.

2.2. Upon acceptance, the User / Client is considered to have acceded to this offer.

2.3. The Company has the right to make changes to this offer. The current version is posted on the Site. Continued use of the Site after the posting of a new version constitutes the User's / Client's consent to such changes.

2.4. If the User / Client does not agree with the terms of this offer, they must cease using the Site and the communication channels posted on the Site.

3. Subject of the Agreement

3.1. The Company provides the User / Client with access to the informational and advertising resource logopedy.kz and the technical ability to send an inquiry to one or more Providers of speech therapy services.

3.2. The Company does not conduct speech diagnostics, does not create correctional programs, does not conduct sessions, does not provide speech therapy, pedagogical, psychological, or medical conclusions, and does not monitor the progress of correction.

3.3. All services are provided exclusively by the Service Provider, who independently determines the methodology, program, and correction plan, the number and duration of sessions, cost, format (in-person or online), indications and feasibility of sessions, as well as terms and prognosis.

3.4. The Company does not provide individual selection of a specialist for a specific case, does not give recommendations on the choice of methodology or specialist, does not make a diagnosis, and does not evaluate indications or contraindications.

3.5. The information on the Site is for informational, advertising, and reference purposes. The final terms, including cost, number of sessions, program, and prognosis, are determined by the Service Provider after conducting diagnostics.

4. Features of the Website Design and Advertising Materials

4.1. The User / Client understands and agrees that the Website may contain commercial, advertising, SEO-optimized, and informational materials about services, including descriptions of correction areas, information about specialists, methodologies, approximate prices, promotions, reviews, booking forms, call buttons, and other elements typical of a speech therapy center website.

4.2. The placement of such materials does not imply that the Company independently provides speech therapy or other correctional services, is a speech therapy center, educational or medical organization, or a party to a service agreement.

4.3. Materials posted on the Site may be provided by Service Providers, prepared based on open sources, commercial descriptions, SEO materials, or information transmitted to the Company by Service Providers.

4.4. Services are provided by the Provider who actually accepted the Client's inquiry, conducted diagnostics, sessions, prepared documents, and/or received payment.

4.5. The use of the Logopedy brand on the Site, as well as phrases such as "our speech therapists," "our center," "our methods," guarantees, and other commercial elements, is driven by SEO (lead generation) requirements and does not alter the Company's legal role as the owner of an informational and advertising resource.

5. One or More Service Providers

5.1. The Company has the right to organize the transfer and/or routing of requests to one or more Providers.

5.2. Different areas may be assigned to different Service Providers, including correction of sound pronunciation, speech initiation and work with speech development delay, correction of stuttering, dysarthria, dyslexia and dysgraphia, school preparation, sessions with children and adults, as well as other areas.

5.3. The Company has the right to change the list of Providers, stop listing one Provider, add another Provider, and distribute inquiries among Providers based on specialization, session format, work schedule, availability, location, expertise, or other criteria.

5.4. The User / Client understands that contact details, phone numbers, messengers, office addresses, information about Contractors, and the routing of inquiries may change.

5.5. Responsibility to the Client (and the person on whose behalf they act) lies with the Provider who actually entered into a relationship with them for the provision of the service.

6. Permits, Qualifications, and Materials

6.1. The Provider is independently responsible for the qualifications of specialists (specialized education in speech therapy, defectology, and related fields), the methods and materials used, and — if the service is provided in a medical format — for having the necessary permits, licenses, and documents.

6.2. The Company may request documents from the Provider confirming their qualifications and right to provide services, but is not a government body, regulator in the field of education or healthcare, expert organization, or quality control authority.

6.3. The Company does not guarantee the availability, validity, completeness, accuracy, or sufficiency of diplomas, certificates, qualifications, experience, permits, premises, equipment, and other conditions of the Service Provider's activities.

6.4. The obligation to verify the Provider's status, the specialist's qualifications, the methods used, conditions, cost, expected result, and other material circumstances lies with the Client.

6.5. The absence, termination, suspension, limitation, or inaccuracy of the Provider's documents, permits, and qualifications is the Provider's responsibility.

7. Procedure for Providing Services

7.1. After submitting a request, all further interaction between the Client and the Provider occurs directly.

7.2. The Provider independently conducts speech diagnostics, assessment, determines the program and correction plan, number, duration, and format of sessions, cost, and feasibility of sessions.

7.3. The Service Provider independently prepares the service agreement, consent to the processing of personal data (including data of a minor — with the consent of the legal representative), payment documents, receipts, and other documents if required by the nature of the service.

7.4. The Company does not maintain correctional, pedagogical, or medical documentation, does not store its originals, does not prescribe a session program, does not monitor their progress, and does not make decisions regarding correction.

7.5. Before starting sessions, the Service Provider is obliged to independently obtain from the Client (legal representative) the necessary consents, including consent for the provision of services to a minor and for the processing of their personal data, if such consents are required.

8. Obligations of the User / Client

8.1. The User / Client is obliged to provide accurate contact information and details necessary for the service provision, including the student's age, speech and development characteristics, established diagnoses, and recommendations from relevant specialists (if any).

8.2. The User / Client is obliged to independently clarify with the Service Provider the cost, number, and format of sessions, the specialist's qualifications, methodology, expected results, and payment procedure.

8.3. The User / Client is obliged to follow the Service Provider's recommendations, including the regularity of sessions and completion of homework, on which the correction result largely depends, if they have entered into a service relationship with the Service Provider.

8.4. The User / Client is obliged to pay for the Provider's services in the manner agreed upon with the Provider.

8.5. When contacting on behalf of a minor or another person, the User confirms that they have the authority of a legal representative and consent for the provision of services and processing of personal data of such person, if required.

9. Obligations of the Company

9.1. The Company undertakes to ensure the availability of the logopedy.kz website and communication channels with reasonable technical reliability.

9.2. The Company has the right to carry out technical maintenance of the Site, SEO promotion, updating materials, connecting and disconnecting Providers, configuring telephony, application forms, messengers, and other communication channels.

9.3. The Company has the right to moderate information posted on the Site, including reviews, specialist profiles, service descriptions, and contact details, at its discretion.

9.4. The Company is entitled to temporarily restrict access to the Website or its individual functions for technical maintenance, updates, error correction, or protection against abuse.

9.5. The Company is not obligated to monitor the actual provision of services, attend sessions, verify methods and qualifications, check the Service Provider's documents in each individual case, or participate in resolving disputes regarding the quality of remediation.

10. Obligations of the Provider

10.1. The Provider is independently obliged to possess the necessary qualifications, knowledge, methods, and, if necessary, permits and documents for providing services.

10.2. The Provider is obligated to provide services properly, in good faith, in compliance with professional standards, safety requirements, and applicable regulations, including when working with minors.

10.3. The Provider is obliged to independently prepare contracts, consents for the processing of personal data (including data of minors), payment documents, and other documents related to the provision of services.

10.4. The Provider is solely responsible for the quality, safety, timelines, cost, result, guarantees, claims, fiscalization, and tax obligations.

10.5. The Service Provider independently bears responsibility for the actions and inactions of its specialists, administrators, employees, and other engaged persons and is not entitled to state to Clients that the Company provides speech therapy services or is its employer.

11. Cost and Payments

11.1. Use of the Website is free for the User / Client. The Company does not charge the Client for access to the Website or the technical ability to contact the Provider.

11.2. Indicative prices, session costs, packages, promotions, and other commercial offers on the Site are for reference and advertising-informational purposes until confirmed by the Provider.

11.3. The final cost of services, number, and duration of sessions are determined by the Service Provider after diagnostics and agreement on the program.

11.4. Payment for services is made by the Client directly to the Service Provider in the manner agreed upon between the Client and the Service Provider.

11.5. The Company does not accept payment for services, is not a payment agent or guarantor of refunds, does not issue fiscal receipts for the Service Provider's services, and bears no tax obligations regarding the Service Provider's income.

11.6. The operation of the Site may be financed through the placement of Contractors, traffic rental, lead rental (lead generation), fees for access to inquiries, advertising placement, subscription fees, or other agreements between the Company and the Contractors.

12. Guarantees

12.1. Any statements regarding the result, timeline, or effectiveness of remediation indicated on the Site are provided solely by the respective Service Provider.

12.2. The Company does not provide any guarantees of achieving correction results, eliminating speech disorders, or regarding the duration of sessions.

12.3. The terms and procedure for providing services, the possibility of repeat or additional sessions, and refunds are determined by the Provider.

12.4. The information posted on the Site does not constitute an independent guarantee obligation of the Company.

12.5. Issues regarding the result, repeat sessions, program changes, refunds, or expense compensation are resolved exclusively between the Client and the Provider.

13. Features and Risks of Speech Therapy Services

13.1. The User / Client understands that the result of speech correction is individual in nature and cannot be guaranteed, as it depends on age, developmental characteristics, concomitant neurological, psychological, and medical conditions, regularity of sessions, as well as completion of homework and recommendations.

13.2. Speech therapy sessions are not medical care in cases where the Provider is not a medical specialist, and do not replace examination and treatment by relevant doctors (neurologist, otorhinolaryngologist, psychiatrist, audiologist, and others).

13.3. The Provider has the right to recommend that the Client (legal representative) consult relevant specialists for diagnosis and treatment; following such recommendations and consulting doctors is at the Client's discretion and responsibility.

13.4. All matters regarding methodology, program, timeline, results, and prognosis of correction are between the Client and the Provider.

13.5. The Company does not make diagnoses, does not assess speech and development status, does not guarantee the achievement of results, and is not liable for the outcome of remedial work.

14. Liability and Risk Allocation

14.1. The Company does not provide speech therapy or other correctional services. All services are provided by independent Providers.

14.2. The Company is not liable for the quality, safety, result, deadlines, cost, integrity, qualifications, or legality of the Contractors' activities.

14.3. The Company is not liable for the actions or omissions of specialists, administrators, employees, and other persons engaged by the Service Provider.

14.4. The Company is not liable for the lack of correction results, incorrectly selected methodology, failure to meet the Client's expectations, the Service Provider's failure to meet deadlines, changes in cost, lack of receipts, or any other actions of the Service Provider.

14.5. The Company is not responsible for the accuracy, completeness, or timeliness of information provided by Providers for posting on the Website.

14.6. The Company is not liable for the inability to contact the Service Provider, changes in the work schedule, changes in the appointment address, the Service Provider's refusal to accept the Client, cancellation, or rescheduling of a session.

14.7. The Company's liability is in any case limited to its role as the owner of the information and advertising resource and the technical communication channel.

15. Claims Procedure

15.1. All claims related to the quality of services, methodology, results, timelines, cost, guarantees, documents, refunds, and other matters of service provision are submitted directly to the Service Provider.

15.2. The Company has the right, but is not obligated, to assist the Client and Provider in communication, sharing contacts, clarifying the request status, or forwarding the inquiry to the responsible person of the Provider.

15.3. Such assistance does not constitute recognition by the Company of the status of a service provider or acceptance of liability for the actions of the Service Provider.

15.4. In the event a claim is received by the Company related to the Provider's actions, the Company has the right to redirect such a claim to the Provider and provide the Client with the Provider's available contact information.

15.5. Claims related solely to the technical operation of the Website, the availability of forms, the correctness of information display, or the operation of communication channels may be sent to the Company using the contacts provided on the Website.

16. Personal Data, Data of Minors, and Communications

16.1. The User / Client agrees to the processing of personal data by the Company to the extent necessary for the operation of the Website, processing of requests, forwarding inquiries to the Provider, communication, analytics, security, dispute resolution, and improvement of the Service quality.

16.2. Such data may include name, phone number, messenger, city, content of the inquiry, information about the desired service, age of the student and speech characteristics (if provided), date and time of inquiry, referral source, technical data, call recordings, correspondence, and other information provided by the User / Client.

16.3. If the inquiry is made on behalf of a minor, the User (legal representative) agrees to the transfer of information about that person to the relevant Service Provider for communication and preliminary processing of the inquiry and confirms they have the legal basis for transferring such information.

16.4. The Company is not an organization that maintains correctional, pedagogical, or medical documentation. The maintenance and storage of documents related to the provision of services are the responsibility of the Contractor.

16.5. Communications may be conducted via telephone, WhatsApp, messengers, website forms, CRM, call tracking, and other technical means.

16.6. The Company has the right to record, log, and store communications for the purposes of confirming the fact of an inquiry, security, quality control of request processing, analytics, dispute resolution, and protection of the Company's rights.

16.7. Data is transferred to the Service Provider to the extent necessary for contacting the User / Client and preliminary processing of the Request.

17. Reviews and Public Statements

17.1. The User / Client has the right to leave reviews about the Site's operation solely regarding its functionality and service characteristics: interface convenience, information accessibility, correctness of displaying information about specialists and contact details, operation of the application form, phone, messenger, and other communication channels.

17.2. Any public statements containing assertions about the quality, methodology, correction results, timelines, cost, actions of the specialist or Service Provider, guarantees, or refunds must be addressed to the relevant Service Provider.

17.3. Publication of a review about the Contractor's services is only possible if the author has proof of the fact of applying for or receiving the service: application number, receipt, contract, screenshot of correspondence, or other supporting material.

17.4. The Company has the right to require confirmation before publishing a review, hide a review until verification, delete reviews containing false information, personal data of third parties (including information about minors) without consent, insults, threats, advertising, spam, or information unrelated to the operation of the Website.

17.5. The User / Client who has accepted this offer agrees that public statements attributing to the Company the actions, duties, or responsibilities of the Service Provider are incorrect with respect to the Company.

17.6. If a User / Client posts a public statement that distorts the Company's role or contains knowingly false information, the Company has the right to demand the removal or correction of such a statement.

17.7. In case of refusal to delete or correct a knowingly false statement, the Company is entitled to file a complaint with the moderation of an external platform, as well as to seek legal protection in the manner established by the legislation of the Republic of Kazakhstan.

18. Informational Nature of Materials

18.1. All materials on the Site, including descriptions of remediation areas, information about specialists, methods, prices, promotions, reviews, answers to questions, and other materials, are of an informational and advertising nature.

18.2. Such materials are not a public offer of the Provider, confirmation of the availability of a specific specialist, or a guarantee of the correction result.

18.3. To obtain accurate information about a service, its cost, program, number of sessions, and prognosis, the Client must contact the Service Provider.

18.4. The Company is not responsible for the Client making decisions independently based on information posted on the Website, without direct confirmation of the conditions and appropriateness of sessions by the Provider.

19. Access Restriction and Abuse

19.1. The Company has the right to restrict the User's / Client's access to the Site or individual functions in case of violation of this offer, provision of false data, abuse of contact forms, spam, threats, insults, attempts to interfere with the Site's operation, or other dishonest actions.

19.2. The Company has the right not to process Requests that contain inaccurate contact details, insults, threats, spam, advertisements, unlawful demands, or information unrelated to the services of speech therapists and speech correction specialists.

20. Final Provisions

20.1. This offer governs the relationship between the User / Client and the Company regarding the use of the Site, submission of Applications, and access to the informational and advertising resource Logopedy.

20.2. This offer does not regulate the relationship regarding the direct provision of speech therapy and other services between the Client and the Service Provider. Such relationships are governed by the service agreement and the legislation applicable to the Service Provider and the Client.

20.3. The invalidity of any individual provision of this offer does not entail the invalidity of the remaining provisions.

20.4. In all other respects, the parties are governed by the legislation of the Republic of Kazakhstan.

20.5. All disputes between the User / Client and the Company are subject to resolution through negotiations, and if resolution is impossible, in accordance with the procedure established by the legislation of the Republic of Kazakhstan.
